Welcome to HeyWhoo! These Terms of Service ("Terms") govern your access to and use of the HeyWhoo mobile application ("App") and related services (collectively, "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Services.

2. Eligibility

You must meet the following requirements to use HeyWhoo:

• Be at least 13 years of age
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the Services under applicable law
• Comply with all local laws regarding online conduct

If you are under 18, you must have parental or guardian consent to use the Services.

3. Account Registration

3.1 Account Creation

To use HeyWhoo, you must create an account by providing:

• A valid email address
• A secure password
• A username/display name
• Your expertise area selection

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Not sharing your account with others

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited conduct.

4. How HeyWhoo Works

4.1 Game Mechanics

HeyWhoo is a social guessing game where:

• You receive 3 daily tokens (resets at midnight UTC)
• Each match costs 1 token
• You are matched with either a human or AI entity
• You chat anonymously to determine if they are human or AI
• You make a guess and earn rewards for correct answers
• Your rankings and statistics are tracked on leaderboards

4.2 Token System

• Daily tokens are automatically replenished
• Bonus tokens can be earned through correct guesses
• Tokens cannot be transferred between users
• Tokens have no real-world monetary value

5. User Conduct and Prohibited Activities

5.1 You Agree to NOT:

• Harass or Abuse: Engage in harassment, hate speech, bullying, or threatening behavior
• Spam: Send repetitive, unsolicited, or promotional messages
• Impersonate: Pretend to be another person or entity
• Cheat: Use bots, scripts, or automated tools to gain unfair advantages
• Exploit: Take advantage of bugs or vulnerabilities in the App
• Share Inappropriate Content: Send sexually explicit, violent, or illegal content
• Violate Privacy: Attempt to discover the real identity of other users
• Manipulate: Engage in vote manipulation or ranking fraud
• Reverse Engineer: Decompile, disassemble, or attempt to extract source code
• Commercial Use: Use the Services for commercial purposes without permission

5.2 Content Standards

All messages and content must be:

• Respectful and appropriate
• Free from illegal content
• Compliant with intellectual property laws
• Not harmful to minors

6. Intellectual Property Rights

6.1 Our Rights

All content, features, and functionality of HeyWhoo, including but not limited to:

• Logo, branding, and design elements
• Software, code, and algorithms
• Text, graphics, and multimedia
• AI models and matching systems

are owned by YHA LLC and protected by copyright, trademark, and other intellectual property laws.

6.2 Your Rights

You retain ownership of the messages and content you create. By using HeyWhoo, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content for the purpose of providing the Services.

6.3 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. Key points:

• Your chats are anonymous and not linked to your real identity
• We do not share your personal information with other users
• We implement security measures to protect your data
• You can request account deletion at any time

8. Disclaimers and Limitations of Liability

8.1 "As Is" Service

HeyWhoo is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation
• Accuracy or reliability of content
• Security of the App

8.2 AI Disclaimer

The AI entities in HeyWhoo are automated systems. We do not guarantee:

• The accuracy or appropriateness of AI responses
• That AI will always behave as expected
• That users can always correctly identify AI vs humans

8.3 User Interactions

We are not responsible for:

• The behavior or conduct of other users
• Content created by users
• Disputes between users
• Any harm resulting from user interactions

8.4 Limitation of Liability

To the fullest extent permitted by law, YHA LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of data or content
• Loss of opportunity
• Emotional distress

Our total liability shall not exceed $100 USD or the amount you paid us (if any) in the past 12 months.

9. Indemnification

You agree to indemnify, defend, and hold harmless YHA LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the Services
• Your content or messages
• Your violation of any rights of another person

10. Modifications to Services and Terms

10.1 Service Changes

We reserve the right to:

• Modify, suspend, or discontinue any part of the Services
• Change features, functionality, or pricing
• Impose limits on certain features

We will provide reasonable notice of material changes when possible.

10.2 Terms Updates

We may update these Terms from time to time. Changes will be effective when posted with an updated "Last Updated" date. Continued use of the Services after changes constitutes acceptance of the new Terms.

11. Termination

11.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in the App

11.2 Termination by Us

We may suspend or terminate your account immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Harmful behavior toward other users
• Abuse of the Services
• At our discretion for any other reason

11.3 Effect of Termination

Upon termination:

• Your right to use the Services ends immediately
• Your account data will be deleted (subject to our Privacy Policy)
• Provisions that should survive termination will remain in effect

12. Dispute Resolution

12.1 Informal Resolution

If you have a dispute with HeyWhoo, please contact us first at heywhoo@yhallc.com. We will work in good faith to resolve the issue.

12.2 Binding Arbitration

If we cannot resolve the dispute informally, you agree that any dispute will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.

12.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in class actions or class arbitrations.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the courts located in [Your Jurisdiction].

These Terms, together with the Privacy Policy, constitute the entire agreement between you and YHA LLC.
